1. Service Description

CherishSong provides custom songwriting and production services. When you place an order:

• You provide a personal story and preferences through our questionnaire
• Our team creates original lyrics and music based on your input
• We deliver a professionally produced song via a shareable link
• You receive an MP3 download of your song

2. Ordering and Payment

Pricing

• Standard Delivery (under 3 days): $40
• Expedited Delivery (12 hours): $40 + $10 = $50

Payment

Payment is processed securely through Stripe. We accept major credit cards, debit cards, Apple Pay, Google Pay, and other payment methods supported by Stripe. Full payment is required at the time of order.

Order Confirmation

After payment, you'll receive an order confirmation email with your order number and estimated delivery date. This email serves as your receipt.

3. Song Creation Process

Our song creation process includes:

1. Lyrics Writing: Our songwriters craft original lyrics based on your story
2. Music Production: Professional musicians create the musical arrangement
3. Quality Review: Final review to ensure high production standards
4. Delivery: Your song is delivered via email with a shareable link

Important: Songs are created specifically for you based on your input. The creative interpretation of your story is at our team's discretion while honoring your selected themes, style, and preferences.

4. Delivery

Delivery times are estimates and begin from the time of order confirmation:

• Standard: In under 3 days
• Expedited: Within 12 hours

While we strive to meet all delivery commitments, occasional delays may occur. We will notify you if your order will be delayed beyond the estimated delivery date.

5. Satisfaction Guarantee & Refunds

Our Guarantee

We want you to love your song. If you're not satisfied with the initial delivery, we'll work with you to make it right.

Revision Policy

We offer revisions to address:

• Factual errors in the lyrics
• Misinterpretation of key details from your story
• Technical audio issues

Revision requests must be submitted within 14 days of delivery.

Refund Policy

• Before Production: Full refund if cancelled before song creation begins
• After Delivery: Refunds considered on a case-by-case basis within 7 days after delivery
• Processing Time: Refunds processed within 5-10 business days

6. Intellectual Property

Your Content

You retain ownership of the stories and personal content you provide. By submitting your story, you grant CherishSong a license to use this content solely for creating your song and displaying it on your song's share page.

Your Song

Upon full payment and delivery, you receive a personal license to:

• Play and share your song for personal, non-commercial purposes
• Share the song link with friends and family
• Download and keep the MP3 file
• Include the song in personal videos (family events, social media)

Restrictions

You may not:

• Sell or commercially distribute your song
• Claim authorship of the lyrics or music
• Remove CherishSong attribution from the share page
• Use the song in commercial advertising or products

7. Content Guidelines

We reserve the right to decline or modify orders that contain:

• Hate speech or discriminatory content
• Explicit sexual content
• Threats or violent content
• Defamatory statements about identifiable individuals
• Content that infringes on others' rights

If we determine your order violates these guidelines, we'll contact you to discuss modifications or offer a full refund.

8. Limitation of Liability

CherishSong provides songs "as is" based on the information you provide. Our liability is limited to:

• The amount you paid for your order
• Providing a revised song or refund at our discretion

We are not liable for indirect, incidental, or consequential damages arising from your use of our service.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our service after changes constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
